The 5th Circuit Court in Louisiana today overturned the injunction on the nationwide CMS mandate. The ruling determined that the court did not have the ability to issue a nationwide injunction, instead the court can only issue an injunction for the 14 states included in the lawsuit. Texas is not included in that lawsuit.
The 8th Circuit Court in Missouri's ruling for an injunction is not affected by today's ruling. There are 10 states included in that lawsuit, their civil liberties also remain intact. Texas is not included in that lawsuit.
The 24 states where there is an active injunction against the CMS mandate are Louisiana, Montana, Arizona, Alabama, Georgia, Idaho, Indiana, Mississippi, Oklahoma, South Carolina, Utah, West Virginia, Kentucky, Ohio, Missouri, Nebraska, Arkansas, Kansas, Iowa, Wyoming, Alaska, South Dakota, North Dakota and New Hampshire.
Once again, Texas healthcare facilities and providers who accept Medicare or Medicaid are now subject to extortion by the Biden Administration.
No official statements from AG Ken Paxton or Governor Abbott at this time on today's developments relating to the CMS mandate.
